Read the Terms of UseThis ChicagoDrivers.com Marketplace Agreement (“Marketplace Agreement,” “Agreement,” or “Terms”) governs the use of the vehicle marketplace operated by Chicago Drivers Inc. (“Chicago Drivers Inc.,” “Chicago Drivers,” “we,” “us,” or “our”) through ChicagoDrivers.com and related marketplace services (collectively, the “Marketplace”). By accessing, using, registering for, posting an advertisement on, responding to an advertisement through, or otherwise participating in the Marketplace, you agree to be bound by this Agreement. If you do not agree to this Agreement, you may not use the Marketplace.
1. PURPOSE OF THE MARKETPLACE
ChicagoDrivers.com provides an online marketplace that allows individuals and businesses to advertise vehicles and allows prospective buyers, renters, and lessees to discover and communicate regarding those vehicles. Vehicles may be advertised for:
- sale;
- rental;
- short-term rental;
- long-term rental;
- short-term lease;
- long-term lease;
- commercial use;
- rideshare use;
- taxi use;
- livery use;
- delivery use;
- personal use; or
- other lawful purposes.
The Marketplace may include passenger vehicles, commercial vehicles, vans, SUVs, sedans, trucks, specialty vehicles, and other vehicles permitted by Chicago Drivers Inc.
2. CHICAGO DRIVERS INC. IS A MARKETPLACE OPERATOR
Chicago Drivers Inc. operates the Marketplace as an online platform. Unless expressly stated otherwise in writing, Chicago Drivers Inc. is not:
- the owner of a vehicle listed on the Marketplace;
- the seller of a vehicle;
- the buyer of a vehicle;
- the lessor of a vehicle;
- the lessee of a vehicle;
- the rental company;
- the rental agent;
- the vehicle dealer;
- the vehicle manufacturer;
- the financing company;
- the insurance company;
- the mechanic;
- the inspection company;
- the title company;
- the escrow company;
- the transportation network company;
- the taxi company;
- the livery company;
- the delivery company;
- a legal representative of a Marketplace user;
- a tax advisor;
- a financial advisor; or
- a party to a transaction between Marketplace users.
Chicago Drivers Inc. does not take ownership or possession of vehicles merely because they are advertised through the Marketplace.
3. NO AGENCY RELATIONSHIP
Use of the Marketplace does not create an agency, partnership, joint venture, employment, franchise, brokerage, fiduciary, or representative relationship between Chicago Drivers Inc. and any Marketplace user. A seller, lessor, buyer, renter, or lessee acts independently. No user has authority to represent that Chicago Drivers Inc. has approved, guaranteed, endorsed, inspected, financed, insured, or otherwise certified a vehicle or transaction unless Chicago Drivers Inc. expressly states so in writing.
4. TYPES OF MARKETPLACE TRANSACTIONS
Marketplace users may advertise vehicles for different transaction types. These may include:
4.1 Sale
A vehicle owner or authorized seller may advertise a vehicle for purchase.
4.2 Rental
A vehicle may be advertised for short-term or long-term rental.
4.3 Lease
A vehicle may be advertised for short-term or long-term lease.
4.4 Commercial Use
A vehicle may be advertised for commercial activities including:
- rideshare;
- taxi;
- livery;
- chauffeur services;
- delivery;
- courier services;
- transportation services;
- business use;
- fleet use; or
- other lawful commercial activities.
Availability of a vehicle through the Marketplace does not mean that the vehicle qualifies for any particular commercial platform, license, permit, insurance program, or regulatory classification.
5. SHORT-TERM AND LONG-TERM ARRANGEMENTS
Users may independently negotiate:
- daily rentals;
- weekly rentals;
- monthly rentals;
- multi-month rentals;
- short-term leases;
- long-term leases;
- annual leases;
- other lawful arrangements.
Chicago Drivers Inc. does not establish the legal terms of a private transaction unless Chicago Drivers Inc. expressly provides a separate transaction agreement. The parties are responsible for establishing written terms addressing matters such as:
- payment;
- security deposits;
- mileage limits;
- mileage charges;
- maintenance;
- repairs;
- insurance;
- fuel;
- charging;
- tolls;
- parking;
- tickets;
- violations;
- accidents;
- damage;
- late returns;
- early termination;
- default;
- repossession;
- permitted drivers;
- geographic restrictions;
- commercial use;
- personal use;
- modifications;
- vehicle condition;
- inspections; and
- other applicable terms.
6. USER RESPONSIBILITY FOR TRANSACTIONS
All transactions are between the Marketplace participants. Chicago Drivers Inc. does not control:
- the price;
- payment terms;
- vehicle condition;
- vehicle availability;
- negotiation;
- title transfer;
- registration;
- insurance;
- financing;
- delivery;
- possession;
- inspection;
- repairs;
- maintenance;
- rental or lease terms;
- security deposits;
- refunds;
- cancellations;
- disputes;
- accidents;
- damage;
- repossession;
- default; or
- performance of either party.
Users are responsible for performing their own due diligence before entering into any transaction.
7. SELLER RESPONSIBILITIES
A seller listing a vehicle must have the legal authority to advertise and sell the vehicle. The seller is responsible for ensuring that the listing information is truthful, accurate, current, and not misleading. A seller must not advertise a vehicle that the seller:
- does not own;
- does not have authority to sell;
- does not have authority to rent;
- does not have authority to lease;
- has stolen;
- is prohibited from transferring;
- is subject to undisclosed restrictions preventing the proposed transaction; or
- otherwise has no lawful right to offer.
8. RENTAL AND LEASE PROVIDER RESPONSIBILITIES
A person or business advertising a vehicle for rent or lease must have the legal authority to do so. The advertiser is responsible for determining whether the proposed rental or lease arrangement complies with:
- federal law;
- Illinois law;
- local ordinances;
- licensing requirements;
- vehicle registration requirements;
- insurance requirements;
- commercial transportation requirements;
- applicable tax requirements;
- rideshare requirements;
- taxi requirements;
- livery requirements;
- delivery requirements; and
- any applicable contractual restrictions.
9. VEHICLE OWNERSHIP AND TITLE
Chicago Drivers Inc. does not independently guarantee ownership or title to any vehicle listed on the Marketplace. Before purchasing, renting, or leasing a vehicle, users should independently verify:
- legal ownership;
- title;
- lien status;
- registration;
- VIN;
- vehicle history;
- odometer information;
- inspection status;
- insurance;
- recalls;
- condition;
- seller identity; and
- any other information relevant to the transaction.
Users should obtain appropriate documentation before completing a transaction.
10. VEHICLE INFORMATION
Listings may contain information including:
- make;
- model;
- year;
- trim;
- VIN;
- mileage;
- price;
- lease price;
- rental price;
- deposit;
- photographs;
- location;
- condition;
- accident history;
- maintenance history;
- title status;
- ownership information;
- financing information;
- commercial-use eligibility;
- rideshare eligibility;
- taxi eligibility;
- livery eligibility;
- delivery suitability;
- insurance information;
- availability;
- lease term;
- rental term;
- mileage limits;
- features;
- equipment;
- modifications; and
- other information supplied by the advertiser.
Chicago Drivers Inc. does not guarantee that any listing information is accurate.
11. NO VEHICLE INSPECTION
Unless Chicago Drivers Inc. expressly identifies a particular vehicle as having undergone an inspection performed by or on behalf of Chicago Drivers Inc., Chicago Drivers Inc. does not inspect vehicles listed on the Marketplace. The appearance of a vehicle listing on ChicagoDrivers.com does not mean that Chicago Drivers Inc. has inspected or approved the vehicle. Users should independently inspect or arrange for inspection of a vehicle before entering into a transaction.
12. NO WARRANTY REGARDING VEHICLE CONDITION
Chicago Drivers Inc. makes no representation or warranty regarding the:
- mechanical condition;
- electrical condition;
- structural condition;
- cosmetic condition;
- safety;
- reliability;
- mileage;
- odometer;
- title;
- ownership;
- accident history;
- maintenance history;
- repair history;
- emissions status;
- inspection status;
- recall status;
- commercial eligibility;
- rideshare eligibility;
- taxi eligibility;
- livery eligibility;
- delivery eligibility;
- insurance eligibility;
- financing eligibility; or
- legal status
of any vehicle listed on the Marketplace.
13. BUYER, RENTER, AND LESSEE DUE DILIGENCE
Before entering into a transaction, users should independently verify information. Depending on the transaction, users may wish to:
- inspect the vehicle;
- test drive the vehicle;
- obtain a professional mechanical inspection;
- verify the VIN;
- obtain a vehicle history report;
- verify title;
- check for liens;
- verify mileage;
- verify registration;
- verify insurance;
- verify commercial eligibility;
- verify licensing requirements;
- verify the seller’s identity;
- verify business registration where applicable;
- review lease or rental documents;
- obtain legal advice;
- obtain insurance advice;
- obtain tax advice; and
- verify applicable regulatory requirements.
14. RIDESHARE VEHICLES
Some Marketplace listings may advertise vehicles as suitable for rideshare services. A statement that a vehicle is “rideshare eligible,” “Uber eligible,” “Lyft eligible,” or similar does not constitute a guarantee by Chicago Drivers Inc. Eligibility may depend on:
- vehicle age;
- vehicle condition;
- vehicle type;
- city;
- state;
- platform requirements;
- inspection;
- insurance;
- driver requirements;
- licensing;
- registration; and
- other requirements.
Users must independently confirm current requirements with the applicable rideshare company and government authorities.
15. TAXI AND LIVERY VEHICLES
Some vehicles may be advertised for taxi, livery, chauffeur, limousine, or other passenger transportation purposes. Chicago Drivers Inc. does not guarantee that any vehicle:
- qualifies as a taxi;
- qualifies as a livery vehicle;
- qualifies as a limousine;
- qualifies for a chauffeur license;
- qualifies for a transportation license;
- satisfies local vehicle requirements;
- satisfies commercial insurance requirements;
- qualifies for a particular transportation company;
- satisfies inspection requirements; or
- may legally be used for a particular transportation purpose.
Users are responsible for verifying all applicable requirements.
16. DELIVERY AND COMMERCIAL VEHICLES
Vehicles may be advertised for:
- food delivery;
- package delivery;
- courier services;
- commercial transportation;
- business operations;
- contractor services; or
- other commercial purposes.
Chicago Drivers Inc. does not guarantee that a vehicle is appropriate or legally qualified for any particular commercial activity. Users are responsible for verifying applicable:
- insurance;
- licensing;
- registration;
- vehicle classifications;
- permits;
- platform requirements;
- weight restrictions;
- commercial requirements; and
- other legal requirements.
17. COMMERCIAL INSURANCE
Commercial use of a vehicle may require insurance beyond ordinary personal automobile insurance. Chicago Drivers Inc. does not provide insurance and does not guarantee that a vehicle is insured for:
- rideshare;
- taxi;
- livery;
- chauffeur;
- delivery;
- rental;
- leasing;
- commercial transportation; or
- any other commercial use.
Users are responsible for obtaining appropriate insurance before operating a vehicle.
18. INSURANCE VERIFICATION
A Marketplace listing that contains insurance information does not constitute verification or certification by Chicago Drivers Inc. Users should independently verify:
- policy status;
- coverage limits;
- permitted use;
- named insured;
- additional insured requirements;
- commercial coverage;
- rental coverage;
- lease coverage;
- rideshare coverage;
- livery coverage;
- deductible;
- exclusions; and
- other applicable terms.
19. PRICING
Advertisers are responsible for the accuracy of pricing. A listed price may or may not include:
- taxes;
- fees;
- deposits;
- insurance;
- mileage;
- delivery;
- registration;
- title fees;
- financing costs;
- maintenance;
- repairs;
- cleaning;
- tolls;
- parking;
- administrative fees; or
- other charges.
Users should confirm the complete financial terms directly with the other party before completing a transaction.
20. DEPOSITS AND FEES
Unless expressly processed through a payment system operated by Chicago Drivers Inc., Chicago Drivers Inc. does not hold or manage:
- security deposits;
- rental deposits;
- lease deposits;
- down payments;
- purchase funds;
- financing funds;
- repair deposits; or
- other transaction funds.
Users should establish written terms concerning deposits, refunds, forfeiture, and deductions.
21. PAYMENTS BETWEEN USERS
Unless Chicago Drivers Inc. expressly provides an integrated payment service for a specific transaction, payments are made directly between Marketplace participants. Chicago Drivers Inc. is not responsible for:
- payment failure;
- payment fraud;
- chargebacks;
- returned checks;
- bank transfers;
- cryptocurrency payments;
- cash payments;
- payment disputes;
- nonpayment;
- refunds; or
- financial losses arising from transactions between users.
22. FRAUD WARNING
Users should be cautious of requests involving:
- wire transfers;
- cryptocurrency;
- gift cards;
- unusual payment methods;
- overpayments;
- fake checks;
- requests to send money to third parties;
- requests for login credentials;
- requests for verification codes;
- requests for Social Security numbers;
- requests for unnecessary banking information;
- urgent payment demands;
- suspicious shipping arrangements;
- unusually low prices; or
- other suspicious behavior.
Chicago Drivers Inc. does not guarantee that Marketplace users are legitimate.
23. OFF-PLATFORM TRANSACTIONS
Users may choose to communicate and complete transactions outside ChicagoDrivers.com. Chicago Drivers Inc. is not responsible for transactions completed outside the Marketplace. If users communicate or transact outside the Marketplace, they do so at their own risk. Chicago Drivers Inc. does not guarantee or monitor the terms, performance, legality, or outcome of off-platform transactions.
24. TRANSACTION DOCUMENTATION
Users are strongly encouraged to use written agreements for:
- vehicle sales;
- rentals;
- leases;
- commercial vehicle arrangements;
- deposits;
- financing;
- vehicle handover;
- mileage requirements;
- damage responsibility; and
- other significant transactions.
For rentals and leases, the parties should consider documenting:
- vehicle condition;
- photographs;
- mileage;
- fuel level;
- damage;
- insurance;
- permitted drivers;
- payment;
- security deposit;
- mileage limits;
- maintenance;
- repairs;
- termination;
- default; and
- return conditions.
25. LISTING REQUIREMENTS
Listings must be:
- accurate;
- lawful;
- relevant;
- non-misleading;
- reasonably complete;
- submitted by an authorized person; and
- consistent with this Agreement.
Chicago Drivers Inc. may establish additional listing requirements.
26. PROHIBITED LISTINGS
Users may not list:
- stolen vehicles;
- vehicles the user does not have authority to offer;
- counterfeit vehicles or documents;
- fraudulent vehicle information;
- fraudulent titles;
- vehicles with falsified VINs;
- vehicles with altered odometers;
- illegal vehicles;
- vehicles prohibited from sale or transfer;
- illegal services;
- fraudulent services;
- stolen parts;
- prohibited goods;
- illegal drugs;
- weapons;
- counterfeit documents;
- fraudulent financial products;
- unlawful transportation services;
- misleading commercial opportunities; or
- other prohibited items or services.
Chicago Drivers Inc. may remove any listing that it believes violates this Agreement or applicable law.
27. FALSE OR MISLEADING INFORMATION
Users may not intentionally provide false or misleading information regarding:
- vehicle ownership;
- title;
- VIN;
- mileage;
- accident history;
- condition;
- maintenance;
- price;
- rental rate;
- lease rate;
- availability;
- insurance;
- commercial eligibility;
- licensing;
- financing;
- identity; or
- other material information.
28. PHOTOGRAPHS
Users must have the right to upload photographs they submit to the Marketplace. Users may not upload photographs that:
- belong to another person without authorization;
- infringe copyright;
- misrepresent the vehicle;
- intentionally conceal material damage;
- contain prohibited content;
- expose unnecessary personal information; or
- otherwise violate this Agreement.
29. LISTING ACCURACY
Advertisers are responsible for updating or removing listings when:
- the vehicle is sold;
- the vehicle is leased;
- the vehicle is rented;
- the vehicle is no longer available;
- the price changes;
- the vehicle condition changes; or
- other material information changes.
Chicago Drivers Inc. does not guarantee that listings will be immediately updated.
30. LISTING REMOVAL
Chicago Drivers Inc. may remove, modify, restrict, suspend, or disable any listing at any time where we reasonably believe that:
- the listing violates this Agreement;
- the listing may be fraudulent;
- the listing may violate law;
- the information is misleading;
- the listing presents a safety concern;
- the listing generates complaints;
- the account is compromised;
- the listing is inappropriate;
- the listing is no longer relevant;
- the listing creates legal risk; or
- removal is otherwise reasonably necessary to operate the Marketplace.
Chicago Drivers Inc. is not required to provide advance notice before removing a listing.
31. ACCOUNT SUSPENSION
Chicago Drivers Inc. may suspend or terminate an account if a user:
- violates this Agreement;
- provides fraudulent information;
- engages in scams;
- repeatedly receives legitimate complaints;
- attempts to manipulate the Marketplace;
- engages in abusive conduct;
- attempts unauthorized access;
- violates applicable law;
- creates security risks;
- uses the Marketplace for prohibited purposes; or
- otherwise creates a material risk to Chicago Drivers Inc., other users, or the Marketplace.
32. USER CONTENT LICENSE
When you submit a listing, photograph, description, advertisement, review, message, or other content to ChicagoDrivers.com (“User Content”), you retain ownership of your User Content. However, you grant Chicago Drivers Inc. a non-exclusive, worldwide, royalty-free, transferable, sublicensable license to host, store, reproduce, display, distribute, format, modify, promote, advertise, and otherwise use your User Content as reasonably necessary to operate, promote, improve, and provide the Marketplace. This license may continue for a reasonable period after removal where necessary for:
- backups;
- technical systems;
- legal records;
- dispute resolution;
- fraud prevention; or
- other legitimate operational purposes.
33. USER REPRESENTATIONS REGARDING CONTENT
By submitting User Content, you represent that:
- you have the right to submit it;
- the information is not intentionally false or misleading;
- you have the necessary rights to photographs and other materials;
- the content does not knowingly violate applicable law;
- the content does not knowingly infringe another person’s rights;
- the content does not contain prohibited material; and
- you have authority to advertise the vehicle or service.
34. MESSAGES AND COMMUNICATIONS
The Marketplace may allow users to communicate with one another. Users are responsible for their communications and conduct. Chicago Drivers Inc. does not guarantee:
- the identity of a person;
- the accuracy of statements;
- the legitimacy of a user;
- the seriousness of an offer;
- the availability of a vehicle;
- the ability of a user to complete a transaction; or
- the outcome of communications.
35. USER VERIFICATION
Chicago Drivers Inc. may offer optional verification features. Verification may involve:
- email verification;
- telephone verification;
- identity verification;
- business verification;
- vehicle verification;
- document verification;
- payment verification; or
- other methods.
Unless explicitly stated otherwise, verification does not guarantee that:
- the user is trustworthy;
- the vehicle is safe;
- the vehicle is owned by the user;
- the listing is accurate;
- the transaction will be completed; or
- the user will perform contractual obligations.
36. REVIEWS AND RATINGS
If the Marketplace permits reviews or ratings, users must provide honest and good-faith feedback. Users may not:
- create fake reviews;
- pay for reviews;
- threaten others to obtain reviews;
- manipulate ratings;
- impersonate other users;
- submit reviews for transactions that did not occur; or
- intentionally submit fraudulent information.
Chicago Drivers Inc. may remove reviews that violate applicable rules.
37. COMMUNICATION WITH ADVERTISERS
By responding to a Marketplace listing, you understand that information necessary to facilitate communication may be shared with the applicable listing owner or advertiser. Users should not provide unnecessary sensitive information during initial communications. Chicago Drivers Inc. may use communication information to:
- facilitate Marketplace communications;
- prevent fraud;
- investigate abuse;
- enforce Marketplace rules;
- provide support; and
- comply with law.
38. NO GUARANTEE OF TRANSACTIONS
Chicago Drivers Inc. does not guarantee that:
- a vehicle will sell;
- a vehicle will rent;
- a vehicle will lease;
- a buyer will be found;
- a renter will be found;
- a lessee will be found;
- a seller will respond;
- a buyer will pay;
- a renter will pay;
- a lessee will pay;
- a vehicle will remain available;
- a transaction will be completed; or
- any user will perform as promised.
39. NO GUARANTEE OF MARKETPLACE AVAILABILITY
Chicago Drivers Inc. does not guarantee uninterrupted availability of the Marketplace. The Marketplace may be unavailable due to:
- maintenance;
- outages;
- software problems;
- hosting problems;
- cybersecurity incidents;
- third-party service interruptions;
- telecommunications problems;
- natural disasters;
- governmental actions;
- technical failures; or
- other circumstances.
40. NO WARRANTY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE MARKETPLACE AND ALL LISTINGS, CONTENT, INFORMATION, AND SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. CHICAGO DRIVERS INC. DISCLAIMS WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF:
- MERCHANTABILITY;
- FITNESS FOR A PARTICULAR PURPOSE;
- TITLE;
- NON-INFRINGEMENT;
- ACCURACY;
- RELIABILITY;
- AVAILABILITY;
- SECURITY; AND
- SUITABILITY.
NOTHING IN THIS AGREEMENT EXCLUDES A WARRANTY OR RIGHT THAT CANNOT LEGALLY BE EXCLUDED.
41. NO ENDORSEMENT
The appearance of a vehicle, seller, business, product, service, advertisement, or listing on ChicagoDrivers.com does not constitute an endorsement, recommendation, certification, or guarantee by Chicago Drivers Inc.
42. THIRD-PARTY SERVICES
The Marketplace may contain links or integrations with third-party services. These may include:
- payment providers;
- vehicle-history providers;
- insurance providers;
- financing providers;
- automotive businesses;
- transportation companies;
- government agencies;
- advertising services;
- mapping services; and
- other third parties.
Chicago Drivers Inc. is not responsible for the products, services, policies, content, or practices of third parties.
43. USER INDEMNIFICATION
To the maximum extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Chicago Drivers Inc. and its owners, officers, directors, employees, contractors, affiliates, agents, service providers, and representatives from claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to:
- your use of the Marketplace;
- your listing;
- your User Content;
- your vehicle;
- your sale;
- your rental;
- your lease;
- your purchase;
- your use of a rented or leased vehicle;
- your communications with another user;
- your violation of this Agreement;
- your violation of law;
- your infringement of another person’s rights;
- your fraud or misconduct; or
- your transaction with another Marketplace participant.
44. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CHICAGO DRIVERS INC. AND ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AFFILIATES, AGENTS, SERVICE PROVIDERS, AND REPRESENTATIVES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO:
- A MARKETPLACE LISTING;
- A VEHICLE;
- A VEHICLE’S CONDITION;
- A SALE;
- A RENTAL;
- A LEASE;
- A PAYMENT;
- A DEPOSIT;
- A REFUND;
- A COMMUNICATION;
- A USER’S CONDUCT;
- PERSONAL INJURY;
- PROPERTY DAMAGE;
- VEHICLE DAMAGE;
- ACCIDENTS;
- LOSS OF INCOME;
- LOSS OF BUSINESS;
- LOSS OF DATA;
- FRAUD;
- THEFT;
- MISREPRESENTATION;
- PLATFORM INTERRUPTION; OR
- ANY OTHER MARKETPLACE TRANSACTION.
45. LIABILITY CAP
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL AGGREGATE LIABILITY OF CHICAGO DRIVERS INC. ARISING OUT OF OR RELATING TO THE MARKETPLACE OR THIS AGREEMENT WILL NOT EXCEED THE GREATER OF:
- THE AMOUNT YOU PAID DIRECTLY TO CHICAGO DRIVERS INC. FOR THE MARKETPLACE SERVICES DURING THE SIX (6) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM; OR
- ONE HUNDRED U.S. DOLLARS (US $100).
This limitation does not apply to liability that cannot legally be limited or excluded under applicable law.
46. PERSONAL INJURY AND PROPERTY DAMAGE
Chicago Drivers Inc. is not responsible for injuries, death, vehicle damage, property damage, or other losses arising from:
- driving;
- test drives;
- vehicle operation;
- vehicle possession;
- vehicle delivery;
- vehicle pickup;
- rental;
- leasing;
- vehicle repairs;
- vehicle defects;
- accidents;
- criminal conduct;
- negligent conduct; or
- other interactions between Marketplace users.
Users are responsible for obtaining appropriate insurance and taking appropriate safety precautions.
47. RELEASE
To the maximum extent permitted by law, you release Chicago Drivers Inc. and its owners, officers, directors, employees, agents, affiliates, contractors, and service providers from claims arising out of or related to disputes or transactions with other Marketplace users. This includes claims relating to:
- vehicle condition;
- vehicle ownership;
- vehicle title;
- vehicle defects;
- payment;
- nonpayment;
- fraud;
- theft;
- misrepresentation;
- personal injury;
- property damage;
- vehicle accidents;
- rental disputes;
- lease disputes;
- sale disputes; and
- other user-to-user disputes.
48. DISPUTES BETWEEN MARKETPLACE USERS
Chicago Drivers Inc. is not required to resolve disputes between Marketplace participants. Users should attempt to resolve disputes directly. Depending on the circumstances, users may seek assistance from:
- an attorney;
- law enforcement;
- insurance companies;
- courts;
- government agencies;
- regulatory agencies; or
- other appropriate professionals.
Chicago Drivers Inc. may, but is not required to, assist with communications or investigate suspected Marketplace violations.
49. ARBITRATION
To the maximum extent permitted by applicable law, disputes between you and Chicago Drivers Inc. arising out of or relating to the Marketplace or this Agreement may be subject to binding individual arbitration rather than litigation in court. The final arbitration procedure, provider, location, applicable rules, exceptions, and class-action waiver should be established by Chicago Drivers Inc.’s attorney and incorporated into the final version of this Agreement. Nothing in this section is intended to eliminate rights that cannot legally be waived.
50. CLASS ACTION WAIVER
To the maximum extent permitted by applicable law, Chicago Drivers Inc. may require claims against it to be brought individually and not as part of a class, collective, representative, or consolidated action. The enforceability and exact wording of this provision should be reviewed by Illinois counsel before publication.
51. GOVERNING LAW
This Agreement should be governed by applicable Illinois law, subject to mandatory federal or state laws that cannot legally be displaced. Any required venue or forum provisions should be finalized by Chicago Drivers Inc.’s attorney.
52. COPYRIGHT AND INTELLECTUAL PROPERTY
ChicagoDrivers.com and its Marketplace may contain:
- software;
- website design;
- graphics;
- logos;
- trademarks;
- text;
- databases;
- photographs;
- interfaces;
- functionality;
- compilations;
- documentation; and
- other intellectual property.
Except for User Content or third-party content, these materials belong to Chicago Drivers Inc. or its licensors. Users may not copy, reproduce, scrape, republish, distribute, sell, modify, reverse engineer, or commercially exploit Marketplace materials without authorization.
53. SCRAPING AND AUTOMATED ACCESS
Users may not use bots, crawlers, scrapers, automated systems, data-mining tools, or similar technologies to systematically collect Marketplace information without written authorization. Chicago Drivers Inc. may take technical and legal measures to prevent unauthorized automated access.
54. PROHIBITED CONDUCT
Users may not:
- impersonate another person;
- create fraudulent accounts;
- manipulate listings;
- manipulate prices;
- manipulate reviews;
- engage in scams;
- collect information for unauthorized purposes;
- harass other users;
- threaten other users;
- transmit malware;
- attempt unauthorized access;
- interfere with Marketplace operations;
- circumvent security controls;
- scrape Marketplace data;
- use the Marketplace for unlawful purposes;
- upload malicious code;
- submit false information;
- advertise stolen property;
- use the Marketplace to facilitate fraud; or
- otherwise misuse the Marketplace.
55. REPORTING SUSPICIOUS LISTINGS
Users may report suspected:
- fraud;
- stolen vehicles;
- false listings;
- scams;
- impersonation;
- illegal activity;
- misleading advertisements;
- prohibited listings; or
- other violations.
Reports may be submitted to:
info@chicagodrivers.com Chicago Drivers Inc. may investigate reports at its discretion.
56. LAW ENFORCEMENT REQUESTS
Chicago Drivers Inc. may cooperate with law enforcement and governmental authorities when required or permitted by law. This may include providing information maintained by Chicago Drivers Inc. pursuant to applicable legal requirements.
57. MARKETPLACE FEES
Chicago Drivers Inc. may charge fees for certain Marketplace services. Fees may include:
- listing fees;
- featured listing fees;
- promoted listing fees;
- advertising fees;
- subscription fees;
- transaction fees;
- lead-generation fees; or
- other service fees.
Applicable fees will be disclosed when required. Chicago Drivers Inc. may change fees prospectively.
58. FEATURED AND PROMOTED LISTINGS
Users may be offered the opportunity to pay for enhanced visibility. Paid placement may include:
- featured listings;
- promoted listings;
- priority placement;
- homepage placement;
- category placement;
- newsletter promotion;
- sponsored listings; or
- other promotional opportunities.
Payment for promotion does not constitute verification, endorsement, or approval of the vehicle or seller.
59. ADVERTISING DISCLOSURE
Marketplace pages may contain advertisements from:
- Google AdSense;
- direct advertisers;
- sponsors;
- affiliates;
- business partners; and
- other advertising providers.
Advertising does not constitute an endorsement by Chicago Drivers Inc.
60. CHANGES TO THE MARKETPLACE
Chicago Drivers Inc. may add, modify, suspend, or discontinue Marketplace features. Changes may include:
- new vehicle categories;
- new transaction types;
- new fees;
- new verification features;
- new advertising options;
- new payment options;
- new geographic areas;
- new user requirements; or
- removal of existing features.
61. TERMINATION
You may stop using the Marketplace at any time. Chicago Drivers Inc. may suspend or terminate access where permitted under this Agreement. Termination does not automatically cancel obligations arising from transactions already entered into between Marketplace users.
62. SURVIVAL
Provisions that by their nature should survive termination will survive, including provisions concerning:
- intellectual property;
- indemnification;
- limitations of liability;
- disclaimers;
- disputes;
- governing law;
- arbitration;
- class-action limitations;
- privacy;
- user obligations; and
- other provisions intended to survive termination.
63. PRIVACY POLICY
Use of the Marketplace is also subject to the ChicagoDrivers.com Privacy Policy. The Privacy Policy explains how Chicago Drivers Inc. collects, uses, stores, and discloses personal information. In the event of a conflict between this Marketplace Agreement and the Privacy Policy concerning the processing of personal information, the Privacy Policy will govern the applicable privacy issue.
64. NO PROFESSIONAL ADVICE
ChicagoDrivers.com does not provide:
- legal advice;
- tax advice;
- accounting advice;
- insurance advice;
- financial advice;
- vehicle inspection services;
- mechanical advice;
- regulatory advice; or
- transportation licensing advice.
Users should obtain professional advice where appropriate.
65. COMPLIANCE WITH LAWS
Each user is responsible for complying with all laws applicable to their activities. Depending on the transaction, this may include laws concerning:
- vehicle sales;
- dealer licensing;
- title transfers;
- registration;
- vehicle rentals;
- vehicle leasing;
- commercial insurance;
- rideshare;
- taxi;
- livery;
- chauffeur services;
- delivery services;
- consumer protection;
- taxation;
- advertising;
- privacy;
- financing;
- lending;
- licensing; and
- other applicable requirements.
66. NO GUARANTEE OF LEGAL ELIGIBILITY
A vehicle appearing on ChicagoDrivers.com does not mean that the vehicle or proposed transaction is legally permitted. Users must independently determine whether their intended use is lawful. This is particularly important for:
- rideshare;
- taxi;
- livery;
- chauffeur;
- delivery;
- commercial transportation;
- rental;
- leasing; and
- cross-jurisdictional operations.
67. ENTIRE AGREEMENT
This Marketplace Agreement, together with applicable:
- Privacy Policy;
- Terms of Use;
- payment terms;
- listing rules;
- promotional terms;
- additional Marketplace policies; and
- other expressly incorporated agreements
constitutes the applicable agreement governing Marketplace use.
68. NO WAIVER
Failure by Chicago Drivers Inc. to enforce a provision does not constitute a waiver of the right to enforce that provision later.
69. SEVERABILITY
If any provision of this Agreement is determined to be invalid or unenforceable, the remaining provisions will remain effective to the maximum extent permitted by law.
70. ASSIGNMENT
Chicago Drivers Inc. may assign or transfer this Agreement or its rights and obligations in connection with:
- a merger;
- acquisition;
- sale;
- reorganization;
- financing;
- restructuring;
- transfer of assets; or
- other business transaction.
Users may not assign their rights or obligations under this Agreement without Chicago Drivers Inc.’s written consent, except where permitted by applicable law.
71. ELECTRONIC ACCEPTANCE
By clicking “I Agree,” “Accept,” “Post Listing,” “Create Listing,” or a similar button, or by otherwise using the Marketplace after being presented with this Agreement, you acknowledge that you have read and agree to this Marketplace Agreement. Electronic acceptance may constitute a legally binding agreement to the extent permitted by applicable law.

73. EFFECTIVE DATE
Effective Date: August 20, 2026 Last Updated: August 20, 2026 By using the ChicagoDrivers.com Marketplace after the effective date, you acknowledge that you have had an opportunity to review and agree to this Marketplace Agreement.
